Prices and availability of products and services are subject to change without notice. We reserve the right to revoke any stated offer and to correct any errors, inaccuracies or omissions including after an order has been submitted and whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged and we cancel your order, we will issue the credit to your credit card. Individual bank policies, outside of our control, dictate when this amount is credited to your account.

ORDER ACCEPTANCE

Fytt reserves the right to refuse any order you place through the site. We may, in our sole discretion, limit or cancel quantities of products purchased per person, per household or per order. These restrictions may include orders placed by or under the same Account, the same credit card, the same email address, or orders that use the same promotion code, billing or shipping address. In the event that we make a change to or cancel an order, we will attempt to notify you by contacting the email and/or billing address/phone number provided at the time the order was made. Verification of information may be required prior to the acceptance of any order.

PRODUCT AVAILABILITY
While we make every effort to display correct inventory stock levels, product availability on the Site is not guaranteed as products may be low in stock or out of stock when an order is completed. Prices displayed on fyttbeauty.com are quoted in U.S. Dollars (USD) and are valid and effective only in the U.S.
COLORS
We have made every effort to display as accurately as possible the colors of our products that appear at the Site. However, as the actual colors you see will depend on your monitor, we cannot guarantee that your monitor’s display of any color will be accurate.
SHIPPING AND PROCESSING
Our shipping and processing charges are intended to compensate our company for the cost of processing your order, handling and packing the products you purchase and delivering them to you. We encourage you to also review detailed information about our shipping and processing fees.
DELIVERY/SHIPPING GUIDELINES
Orders placed Monday-Friday will begin processing the next business day, excluding holidays and weekends, and will ship within 24-48 hours pending availability and credit verification. Orders placed on Friday after 1PM PST will begin processing on the following Monday. Fytt customer support will contact you with a follow-up email if the merchandise you have selected is not currently in stock or if we need additional identification provided for credit verification.
If you still have not received your purchase after 1 weeks, please email contact us using the “Contact Us” form. All California deliveries will incur an x% sales tax. Please contact if you have any questions. Please be advised that once an order has been placed we are unable to make any modifications to the order including cancellations.
REFUSED SHIPMENTS
If you decide to refuse any shipments from fyttbeauty.com you are responsible for the original shipping charges to you that are incurred on the package (on both the original and return shipments), and the cost of returning the package to lakai.com. This amount will be subtracted from your merchandise refund.
TRACKING YOUR ORDER
You will receive an order confirmation once your order has been successfully transmitted. In addition, a shipping confirmation email will be sent once your order has been shipped. This confirmation will include the tracking number for your package.
RETURN POLICY
WE DO NOT ACCEPT RETURNS ON PRODUCTS THAT WERE NOT PURCHASED VIA THIS WEBSITE.
We stand behind our products and want you to be 100% satisfied. You may return or exchange any unopened within 30 days of purchase by contacting us. We will provide you a return authorization number as well as shipping instructions for your return package. A return shipping fee will be deducted from the refund amount unless the return was a result of our error or the product was damaged or defective.
PRODUCT WARNINGS
Only use Fytt products as instructed by the instructions appearing on the product. Never eat, nor drink the product contents; nor put the product or its contents into the eyes.
INDEMNIFICATION
You agree to defend, indemnify and hold Fytt harmless and against any and all claims, damages, costs and expenses, including attorneys’ fees, arising from or related to your use of the Site.
CLASS ACTION WAIVER
Where permitted under the applicable law, you and Fytt agree that each may bring claims against the other only in your or its individual capacity and NOT as a plaintiff or class member in any purported class or representative action. Further, unless both you and Fytt agree, no judge nor any arbitrator may consolidate more than one person’s claims or otherwise preside over any form of a representative or class proceeding as related to litigating terms of this Agreement, including litigating breach of this Agreement.
ATTORNEY FEES AND COSTS
The prevailing party in any litigation relating to terms of this Agreement and/or breach of this Agreement shall be entitled to recover its reasonable attorneys’ fees and litigation costs incurred.
CHOICE OF LAW
The Terms shall be governed by and construed in accordance with the laws of the State of California, United States of America, without regard to conflict of laws provisions. You hereby consent to the exclusive jurisdiction and venue of the federal or state courts in Los Angeles County, California in all disputes arising out of or relating to the use of the Site. Use of the Site is unauthorized in any jurisdiction that does not give effect to all provisions of these Terms, including without limitation this paragraph.
NO AGENCY
You agree that no joint venture, partnership, employment, or agency relationship exists between you and Fytt as a result of this agreement or use of the Site.
NO IMPLIED WAIVER
Either party’s failure to insist in any one or more instances upon strict performance by the other party of any of the terms of this Agreement shall not be construed as a waiver of any continuing or subsequent failure to perform or delay in performance of any term hereof.
SEVERABILITY
If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.
FINAL AGREEMENT
Unless otherwise specified herein, this Agreement constitutes the entire agreement between the user and Fytt with respect to the Site and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the user and Fytt with respect to the Site. A printed version of this Agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this Agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.
TERMINATION
Fytt reserves the right, in its sole discretion, to terminate your right to use the Site and any rights provided to you under these terms at any time, without notice, and accordingly deny you access to the Site, if you fail to comply with any term or provision. Upon termination, you must promptly destroy all materials downloaded or otherwise obtained from this Site, as well as all copies of such materials.
INFLUENCER PARTNERSHIP
By participating, you agree that Fytt has the permission to use the photos on our website and/or on our social media channels; and your photos may be used for promotional purposes.
HEADINGS
Headings used in this Agreement are provided for convenience only and shall not be used to construe meaning or intent.
